Cell Site Lease Termination & Decommissioning
When a carrier decides to proceed with cell site lease termination and decommissioning of the facility, property owners face a different but equally serious set of risks. Carriers have strong financial incentives to minimize the cost and scope of their exit obligations. Lease agreements, particularly older ones, may not clearly define what removal and restoration requires. What Property Owners Are Owed
At termination, a carrier’s obligations typically include:
- Proper written notice of termination in compliance with the lease’s notice provisions
- Payment of all rent through at least the the effective date of termination, including any applicable notice periods, if not also the equipment removal and restoration period
- Complete removal of all equipment, structures, and improvements installed during the lease term
- Restoration of the premises to its pre-lease condition, including remediation of any damage caused by installation or equipment
- Resolution of any outstanding compliance issues, insurance obligations, or indemnity claims
- Return of the premises free and clear of any liens, encumbrances, or third-party claims arising from the carrier’s occupancy
When Carriers Fall Short
In practice, departing carriers frequently attempt to leave partial equipment, foundations, or utilities in place, claim that certain structures were pre-existing, or delay removal indefinitely. Some carriers abandon sites entirely without completing their restoration obligations, leaving property owners to manage structures they did not build and did not want.
